Terms of Service, Website Disclaimer & Limitation of Liability

1. Nature of the Service

The Site provides election forecasts, prediction market prices, public poll averages, research, analysis and related content for informational purposes only. The Precision Combined number is a statistical blend of third-party sources and is not a guarantee of any outcome. Nothing on the Site is legal, financial, investment, tax, campaign strategy or other professional advice, and nothing on the Site is a recommendation to place any trade or wager.

2. Eligibility

You must be at least 18 years old to pre-register as a founding member, take member polls or earn Precision Tokens. Membership is open to residents of the United States. We may verify your identity, age and residence before any reward is granted, and we may refuse or cancel any registration that is duplicate, automated, fraudulent or otherwise in breach of these Terms.

3. Founding-Member Pre-Registration

Pre-registration reserves your place on our founding-member list. It is free, it does not create an account with any balance or financial value, and it does not obligate you to do anything further. We will contact you, using only the channels you opted in to, when pre-registration opens and when the member panel launches.

Each pre-registered member receives a personal invite link. Referral rewards are earned only when the invited person is a real, eligible individual who completes verification. Self-referrals, multiple accounts, purchased or automated sign-ups, and incentivized spam are prohibited and void any related rewards.

4. Precision Tokens

Precision Tokens are a record of rewards we intend to credit to eligible members for activities such as verified sign-up, completing member polls and verified referrals. Reward amounts shown on the Site are planned amounts and may change before launch. Rewards are recorded as pending until we complete verification.

During pre-registration, Precision Tokens are locked. They cannot be sold, transferred, assigned, pledged or redeemed, they have no cash value, and they do not represent equity, debt, a profit share or any other interest in Precision Polling and Research. We do not promise that Precision Tokens will ever have value or become transferable or tradable.

Any future opportunity to redeem, purchase or trade tokens, or to invest in Precision Polling and Research, would be made only through formal offering documents under an exemption from, or registration with, applicable U.S. securities laws, and only to persons eligible to participate. Nothing on the Site is an offer to sell or a solicitation of an offer to buy any security. Expressing interest in a future offering is not a commitment by you or by us.

5. Forward-Looking Statements, Offering Communications and Trademarks

Statements on this Site about Precision Tokens, the founding-member token pool, a future token offering and the timing of any filing are forward-looking statements. Words such as "intends", "expects", "currently expects", "plans", "goal" and "may" identify them. They reflect management's current intent and expectations only. They are not promises or guarantees, and actual events may differ materially.

These statements depend on, among other things, the advice of legal counsel, review by the U.S. Securities and Exchange Commission and other regulators, the availability of an exemption from registration, market conditions and the Company's financial condition. Management may change or abandon any of these plans, including the size of the founding-member pool, the per-member limit and the March 31, 2027 filing goal, at any time and without notice. We undertake no obligation to update any forward-looking statement.

Rule 255 notice. Any statement on this Site about a possible token offering may be a communication to test the waters under Regulation A. No money or other consideration is being solicited, and if any is sent in response, it will not be accepted. No offer to buy the securities can be accepted, and no part of the purchase price can be received, until an offering statement on Form 1-A is filed and qualified by the SEC. Any such offer may be withdrawn or revoked, without obligation or commitment of any kind, at any time before notice of its acceptance is given after the qualification date. Nothing on this Site is an offer to sell, or a solicitation of an offer to buy, any security or token. Precision Tokens are locked, non-transferable and have no cash value, and no price, trading venue or secondary market is represented or implied.

6. Member Polls and Payments

After launch, verified members may be invited to complete polls and may be paid for completed polls at rates we publish at that time. We may decline a response that fails quality checks. Member responses are used in aggregate; we do not publish an individual member's answers with their name.

7. Text Message Program

Program name: America First Polling Member Texts. When you enter your mobile number at sign-up, you agree to receive account text messages from America First Polling: one-time verification and sign-in codes (2FA), security and fraud alerts, account notifications and replies to your support requests. If you also check the optional text-message box, you agree to receive recurring automated text messages, including marketing messages, about new member polls and voting reminders, poll results, public service announcements, launch and membership updates, AFP Token rewards and promotions. Consent is not a condition of membership or of any purchase.

Message frequency varies; optional Member Texts are sent up to 10 messages per month. Message and data rates may apply. Reply STOP to any message to cancel; you will receive one confirmation and no further messages. Reply HELP for help, or email info@americafirstpolling.org. Carriers are not liable for delayed or undelivered messages. You confirm you are the subscriber or authorized user of the mobile number you provided.

We do not share mobile numbers or text-message opt-in data and consent with third parties or affiliates for their marketing or promotional purposes.

8. Email

If you check the email box on our sign-up form, you agree to receive emails about pre-registration, launch news, member polls and your rewards. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests promptly as required by the CAN-SPAM Act.

9. No Warranty

THE SITE AND ALL CONTENT, DATA, FORECASTS, POLLS, AVERAGES, MARKET INFORMATION, ANALYSES AND MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT OR TITLE.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10. Third-Party Data

Much of the data on the Site comes from third parties, including Kalshi, Polymarket, PredictIt, VoteHub and public pollsters. We credit and link each source, but we do not control or guarantee the accuracy, completeness or timeliness of third-party data. PredictIt data is shown under its non-commercial license and VoteHub data under CC BY 4.0. Any reliance on third-party data or on any content from the Site is at your sole risk.

11. Acceptable Use

You agree not to scrape the Site in a way that burdens it, interfere with its security or operation, submit false information, impersonate anyone, or use the Site for any unlawful purpose.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRECISION POLLING AND RESEARCH AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS AND ASSIGNS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SITE, PRE-REGISTRATION, PRECISION TOKENS OR ANY CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THESE TERMS OR THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100.00).

13. Indemnification

You agree to indemnify, defend and hold harmless Precision Polling and Research and its officers, directors, employees, agents, affiliates, successors and assigns from all claims, damages, losses, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any third party’s rights.

14. Binding Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted in Cheyenne, Wyoming or by video conference, unless the parties agree otherwise in writing. Judgment on the award may be entered in any court of competent jurisdiction. Either party may bring an individual claim in small claims court instead.

YOU AND THE COMPANY EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS, COLLECTIVE OR REPRESENTATIVE PROCEEDING.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of laws principles, and by applicable U.S. federal law.

16. Privacy

Our collection and use of personal information is governed by our Privacy Policy, which is part of these Terms. We never sell your personal information.

17. Changes

We may update these Terms. Updated Terms will be posted on this page with a new “Last Updated” date. Material changes affecting members will also be sent to members by email. Continued use of the Site after changes take effect means you accept them.

18. Severability and Entire Agreement

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent possible and the rest will remain in effect. These Terms and our Privacy Policy are the entire agreement between you and Precision Polling and Research about the Site.
